CODE OF REGULATIONS ON TRANSFERRING ADMISSION TICKETS TO FOOTBALL MATCHES

Given

  • the Memorandum of Understanding drawn up by the Professional Leagues and the FIGC, the other Leagues, AIC, AIAC and AIA, together with the Ministry of the Interior, the Presidency of the Council of Ministers – Ministry for Sport and CONI, on the “new model for the management of football events” in order to safeguard and promote the “social dimension of football” on 4 August 2017;
  • that one of the tools provided for in the Protocol to achieve these objectives is the accountability of clubs with regards to ticket policies, to be implemented (also) through the introduction of the so-called “system of approval”;
  • that the approval system is a tool made available to Clubsto exclude from stadiums, for an appropriate time, those who cannot maintain a good conduct in accordance with the Club’s “code of conduct”;
  • that through the approval system, the Clubs are active in guaranteeing a welcoming, safe and suitable environment for all types of spectators, including families with children;
  • that all the LNPA Clubs condemn any violent conduct, including verbal conduct, and any con- duct that directly or indirectly leads to offence, denigration or insult for reasons of race, co- lour, religion, language, gender, nationality, ethnic origin or amounts to unlawful ideological propaganda or in any case praising discriminatory conducts or, more generally, that the Club deems inappropriate or not representative of their tradition and sporting identity;
  • that all those who access, for any reason, events organised by the same clubs must respect the same values and generally recognised behaviours, of civil coexistence, respect, well-being and safety of all;

Art. 12 of the Sports Justice Code;

These “Code Regulating the Transfer of Tickets for Football Matches” (hereinafter: Code) have been adopted and the following provisions shall apply.

Art. 1

Definition

“Acceptance requirement” (hereafter: Acceptance) is a strictly private tool.
The Club Atalanta Bergamasca Calcio S.r.l. has the right to refuse to sell tickets or to temporarily or definitively suspend the validity of a ticket, if they have been already sold, to people who are “not welcome” in accordance with this Code.
Acceptance applies not only to any conduct that occurs after a match ticket, season ticket or loyalty card has been purchased, but also to any conduct that pre-dates the purchase of the ticket or card.

Art.2

Relevant conduct

Any conduct connected directly to a football event (hereafter: Event) is relevant for the purposes of Art. 1 above, regardless of the place and time at which it took place.
For the purpose of this Code, a football event is any initiative or occasion opened to the public organised by the Club and is therefore not limited to the official events.
Any conduct that conflicts with the values of sport and public dignity is relevant for this purpose and shall be disapproved, as well as any act that amounts to racial, territorial, ethnic or religious discrimination against the fans of the opposing team, personnel, public institutions or civil society.

It also includes any actions which may result in administrative fines for the Club, or which may damage the Club’s interests and/or image (including but not limited to any infringement of the Stadium Regulations, the unauthorised broadcasting of images considered to infringe radio or television rights and copyright infringement or of data for betting purposes).

Finally, shall be considered relevant for this purpose any infringement of the Stadium Regulations, ticket touting and the sale or purchase of tickets through unofficial channels or web- sites that fuel the market for secondary ticketing, entering the stadium without a ticket or bringing in a ticket without a valid entry code and/or a code that does not correspond to the bearer’s identity and invading the pitch, entering or attempting to enter prohibited areas, con- ducting commercial or promotional activities inside and/or close to the stadium if they have not been authorised by the Club).

Art.3

Conditions

Any resulting ban will not give any right to any form of reimbursement.
The transfer of a purchased ticket from the person who is “not welcomed” to a third party is permitted, unless specifically forbidden, if the transferee meets the eligibility criteria.
A ban will not affect any benefits obtained from the loyalty programmes unless the benefit relates to the event for which the ban was imposed. In such a case, the loyalty reward may be used for the match subsequent to the prohibited match, where permitted by the calendar for that season, otherwise the reward will be lost.
If, during a period of suspension, another prohibited act is committed by the supporter, a further ban may be imposed, which will be added to the previous one and may not be combined with it.
Regardless of where the prohibited act was carried out, the right to refuse admission will only be exercised for supporters attending matches played at the stadium used by the Club for the home matches, and therefore does not include away matches.

Advertising

The current version of this Code is published, since its adoption, on the official website of the Club www.atalanta.it, and at all the betting shops and the entrance gates of the sports facilities and grounds associated with the Club Atalanta Bergamasca Calcio S.r.l.

Art.5

Sources

The Club may detect unacceptable conduct through:
− reports from stewards, the Club’s security manager, the Supporter Liaison Officer department and/or other personnel of the Club Atalanta Bergamasca Calcio S.r.l.;
− images from the video surveillance system;
− images posted on social networks where it is possible to identify the person believed to be responsible of such conduct;
− open sources, for incidents which have been verified publicly.

Art. 6

Evaluation parameters

The following factors are evaluation parameters for the purpose of this Code:

  1. fault or guilt for not welcome behaviour, in relation to an obvious premeditation and/or, on the contrary, emotive reaction;
    2. the type of legal asset “attacked”;
    3. any past conduct that amounts to a repetition of the offence or that led to a simple warning;
  2. subsequent conduct which substantiates active repentance or a clear intention to collaborate in order to eliminate or reduce the potential consequences of an offence against the Club Atalanta Bergamasca Calcio S.r.l., arising from the sanctioned conduct, including an admission of personal responsibility and the actual repentance/apology by the party concerned;
  3. the role played by the person, as instigator and/or promoter of the conduct, or as mere participant. The acts committed inside the stadium, which include a breach of the regulations of use, will be punished by both types of provisions (fines and bans), as they are of different nature.

Art.7

Duration of the provisions

The duration of a ban is proportionate to the seriousness of the act committed, which will be determined according to the criteria set out in Art. 6.
The range of a ban may vary from a minimum of one or more days through to a determined number of seasons.
Through a special IT platform, the Club Atalanta Bergamasca Calcio S.r.l. will record and give notice of the period of suspension of acceptance to the ticketing company of home matches, by inserting an alert that will be registered, collected and processed in compliance with the privacy regulation in force at the time.

Art.8

Procedure

The objection to the conduct containing the description of the beaches, is communicated to the person who has been identified, through the data registered for providing the admission ticket (if the conduct is subsequent to the issue of the ticket), or through direct knowledge, or through the aid of the Police Force, which the Sports Club may address in all cases in which it intends to report the person (should the conditions be met), by registered letter or other notification method, within 7 days from the identification of the person to whom the relevant conduct is attributed.
The identified person may submit his “justifications” to the Club for evaluation with the aim of modifying or withdrawing the provision and to request a hearing, within 5 days after receiving the complaint.
The Club will issue its decision in respect of any such request within 20 days.
If no response is received from the Club after 20 days, the appeal must be considered rejected.

Art.9

Minors

It is possible to impose bans on minors, provided that they are aged between fourteen and eighteen years of age.
The minor holding a season ticket, whose parent is facing a ban imposed by the Club Atalanta Bergamasca Calcio S.r.l., may be accompanied to the stadium by another adult holding a valid ticket.

Art.10

Links with other procedures

The application of the above-mentioned right to refuse admission and the imposition of bans will not affect any other criminal/civil proceedings, as the conduct subject of investigation may harm different interests.
In any case, the imposing of a ban does not affect the right of the Club to take action in any court of law against the perpetrator of the breach.
