1. The tickets are assigned by name and entitle the holder to watch the home matches of the First Team of Atalanta B.C. S.p.A. (hereafter “ATALANTA”) to which the ticket refers, from the assigned seat (or from a seat different from the one indicated on the ticket and that can be eventually assigned to the holder by Atalanta B.C. for valid organisational reasons, in case of exceptional circumstances or for force majeure, public order, safety reasons or according to the Public or Sports Authorities provisions), that are held in compliance with the applicable to these matches Sports Regulations of Serie A 2021/2022, Coppa Italia 2021/2022 or the UEFA Champions League 2021/2022 and in accordance with the calendar, date, and place established by Lega Nazionale Professionisti Serie A or by UEFA, including any variation, whatever their cause, that must be considered usual and taken into account by the Holder when purchasing the Access tickets. By purchasing the ticket, the Holder is obliged to find information and updates regarding the date, time and place of home matches. Any changes to the fixtures, with consequent modification of the date or time or place of the home matches do not give the right to reimbursement of the price of the single Access ticket, as well as to compensation for any expenses, of any nature.
2. The purchase of Access tickets implies the acceptance and compliance with these Terms and Conditions of use of tickets. The Ticket Holder, duly identified on the ticket, obtains the issuance of the tickets in their name by signing the contract of purchase.
3. The Ticket Holder may not use the ticket for trading and/or speculative purposes or put on sale or resell their seat or transfer it to third parties for commercial purposes (including through online sale platforms such as Ticket4football, Ticketbis, Viagogo, Seatwave, My Way Ticket), even as part of a complementary service/product offering, except for the cases expressly allowed by Atalanta.
4. The Ticket Holder is entitled to transfer the Access ticket, according to the present Terms and Conditions, through the online change name service to make a change to the user name of the Access ticket, following the procedure specified below: a Change of Name procedure (a free transfer of the seat allocated to the Ticket Holder by their ticket per match – where the Ticket Holder is in possession of the valid Fidelity Card “DEA CARD” issued by Atalanta). The right to transfer the Access ticket is subject to eventual restrictions applied to single matches and imposed by the competent authorities or by Atalanta. Any unauthorised transfer of the Access ticket or improper use of the name change procedure constitutes illegal use of the ticket. You may access the Name change procedure directly through the Ticketing service portal.
5. As provided under the rules of Lega Nazionale Professionisti Serie A – F.I.G.C., where any Match of Serie A 2021/2022 or Coppa Italia 2021/2022 is suspended after the start of the second half, the ticket will not be valid for the rearranged fixture.
6. In order to access the Stadium, the Holder shall use their own Fidelity Card “DEA CARD” if the digital Access ticket was uploaded onto it or a printed ticket regularly issued in traditional mode or home@ticketing in their possession. The ticket or the aforementioned Fidelity Card are the only valid documents that allow access to the Stadium and shall be submitted together with a valid identity document (identity card, passport or driving license).
7. Should the Ticket Holder be subject to any administrative or legal procedure that imposes a ban on accessing stadiums (Law 401/89 and subsequent modifications) or become liable for a violation of the Rules of the Facility use and/or the Code of regulations or violate the transfer prohibition specified in paragraphs 3 and 4, the ticket may be cancelled or the access to the stadium may be prohibited and the Ticket Holder will not be entitled to any reimbursement or compensation for the unused ticket.
8. The use of the ticket implies acceptance of the present conditions as well as the provisions of the Rules of the Facility use and the Code of regulations of the sports facility where Atalanta hold their home matches. Both documents will be affixed both inside and outside the stadium and publicised on the website www.atalanta.it. The observance of the aforementioned documents is an indispensable condition in order for the spectators to access sports facilities and stay at sports facilities. Furthermore, access to the sport facilities may involve mandatory personal and safety searches of the person concerned and their bags and other belongings they are carrying along, with the sole aim of preventing anyone from carrying illegal objects or illegal substances inside the stadium, which are prohibited or which encourage or provoke acts of violence.
9. The ticket Holders are required to conduct in a way that will not disturb other spectators and shall not carry out any actions intended to denigrate, offend or publicly challenge any persons, authorities or public or private institutions in an obvious manner as well as the Club and its employees and/or representatives. The Club is entitled to prohibit the spectator from entering the sports facility where such actions take place.
10. Concerning the provision of leisure-related services referred to in Article 59 paragraph 1 (n) of the Consumer Code (Legislative Decree n. 206/2005, as amended by Legislative Decree 21/2014), the right of withdrawal is not recognised to purchasers of tickets, as provided for in Article 52 and subsequent articles of the Consumer Code.
11. These Terms and Conditions are governed by Italian law. Disputes concerning the validity, application, interpretation, performance or termination of these Conditions shall fall under the jurisdiction of the Chamber of Commerce of Bergamo and shall be resolved by the Rules of Conciliation adopted by the Chamber of Commerce of Bergamo. If either Party intends to refer the matter to the ordinary judicial authority, the exclusive and binding jurisdiction falls under the Court of Bergamo, or the court of the place of residence or elective domicile of the customer, where the latter qualifies as a consumer under Italian Legislative Decree no. 206/2005 as amended and supplemented.
12. Service fees may be charged to purchasers of tickets in the phase of purchase in the points of sale or through the portals of Ticketing service managed by the Club.
13. Atalanta, as the Organiser of the Event, is entitled to opt for an eventual general sale of tickets, following the private sale.
14. Atalanta guarantees that the personal data collected in the signing phase of purchase will be processed in compliance with EU Regulation no. 679/2016 (General Data Protection Regulation).
15. Atalanta reserves the right at any time to amend the present Terms and Conditions with immediate effect. All relevant information regarding eventual amendments or other aspects regarding tickets will be published on the official website of Atalanta www.atalanta.it.
